Judiciary should play its due role instead not to be flexible giving stay-order to ‘’disqualified candidates’’ whose rigging in the General election 2013 has been confirmed by Election tribunal.

Why Judiciary gives its verdict in ambivalence & ambiguity if the case pertains to General Election 2013 - leaving the room opened for the fraudsters instead to black list the Politicians who wins the election with illicit means and later it proves the irregularity in the votes polled?

A very harsh action indeed is sought to keep such politicians away of the electoral process whose illicit practices make the election controversial and ineffective.

Just think that it is 2-1/2 years have gone but still we are investigating & digging out the irregularities in the election and busy in by-election – announcing the previous election result null and void and preparing for re-polling.

Instead to do any legislation in the assembly for people betterment and advancement in the country – Is it not the wastage of time and money?

If the court once has disqualified the candidate investigating the rigging carried out in the Election (held in the given constituency) & advising Election commission of Pakistan (ECP) to re conduct the poll substantiating the forgeries and manipulation did by the candidate.

Highlighting the mismanagement and irregularity on the part of ECP who failed and could not ensure a free, fair and transparent election - declaring the election null and void and disqualifying the candidate.

And the disqualified candidate then approaches the Supreme Court and obtains ‘’stay order’’ and how ridiculed it is that the same ‘’disqualified person’’ does not surrender its ministerial position - keeping his status alive in the assembly – continuing with the same authority & official power conferred him - enjoying with the same salary, benefits and perk applicable to a living minister.

So what stands for disqualification? If the candidate has already been asked to de-seat with immediate effect as soon as the Election tribunal announced its verdict?

And the ECP whom the court has asked to re conduct the polling - goes in effective & valueless as the candidate does not care or give any preference to the call of ECP  - waving the flag of ‘’stay order’’ acquired from Supreme court.

So the question of course comes ahead that where is the empowerment & delegated authority of ECP? Why Supreme Court intervenes in its matter - If ECP has been asked to re conduct the polling of given constituency.

Fixing charges against ECP who did not ensure unbiased, impartial and tampered-free election - alleging systematic error on the part of ECP and what a ridiculous not giving opportunity to conduct re-polling – does it not lead to encroach & usurp the ECP’s normal business?

ECP is a separate and an independent entity having its own criteria to run electoral business in the country - so to make the institution competent, effective and functional the court should not invade & subdue ECP delegated authority and impose their orders.

As the percept had been where the Ex Chief Justice of Supreme court influenced - kept isolated and barred Election Commissioner Fakhreddin G Ibrahim (FGI) an octogenarian where Ex CJ overpowered & disabled him to perform electoral duties - took over the whole election responsibilities in his hand particularly in Punjab.

A big province in terms of population where whoever qualifies or wins the election makes the govt. in federation – and that’s the reason that despite passing 2-1/2 years still the ECP, 
Election tribunal, NADRA and Judiciary are involved in digging out the cases.

Examining and investigating the polled votes – voter thumb impression, NIC genuineness, excess printing of ballot papers, magnetic ink etc. are the issues which has been an stigma on part of ECP who seems still busy in the game played in Punjab.

Again, if the disqualified candidate not surrendering his position dancing & holding stay order in hand then what is the use of Election tribunal verdict? How the mismanagement and irregularity charges levelled against ECP can be revamped & restructured if it is not treated an independent govt. department.  

Everyone knows that General Election 2013 held in Pakistan has been controversial, suspicious and unhealthy.

A living beat not only among journalist but a serious debate among politicians and hot topics among 200 million people of Pakistan too who have been watching politicians madness, lunacy and insaneness where allegation and counter allegation ‘’making the election unfair and tampered’’ being claimed still.

Though Pakistan Muslim League Nawaz (PML-N) made the govt. getting more than 2/3 majority in the said election but Imran Khan (IK) Pakistan Tehrik-e-Insaf (PTI) did not accept the election result on the very first day & start vociferating to investigate the fraud & forgeries and massive rigging noticed by PTI on part of ECP.

PTI though raised the issue in the parliament, also submitted his appeal to ECP to open the bags at least of 4 constituencies where PTI had serious concerns but neither National Assembly (NA) nor ECP and even the Supreme Court honoured PTI claims – I knocked the door everywhere but no one listened us - I had no way except to go in the street, said IK.

Eventually PTI went on Sit-in (dharna-call) where they remained for 126 days in Islamabad under the stroke of chilled winter and sizzling heat but due to massacre of children in Army Public School Peshawar the Sit-in was suspended by PTI chairman IK.

PML-N however guaranteed PTI to form a Judicial commission in Supreme court of Pakistan investigating the PTI claims if the election did not go free, fair and impartial, convinced by Ishaq Dar a cardinal member of govt. team.

In short the judicial commission (JC) probing into allegation of (MUNNAZAM DHANDLI) systematic rigging in General election 2013 rejected the plea of PTI and said there were no organized rigging during elections.

Despite some lapses on part of Election Commission of Pakistan (ECP) “the 2013 general elections were in large part organised and conducted fairly and in accordance with the law.”
But JC also mentioned in its verdict highlighting 40 situations where ECP perpetrated of not arranging a fair election, said IK

Judicial commission added that there were no plan, design to manipulate or influence the election systematically could not be proven by any of the parties to the proceedings nor it is evident from the evidences produced before the commission.

The inquiry commission concluded in its report that “despite some lapses by the ECP it cannot be said on the evidence before the Commission that on the overall basis the elections were not a true and fair reflection of the mandate given by the electorate.”

No doubt it was a very tasty and marvellous lollypop from the judiciary to PTI but IK having no option except to accept the judicial commission report.

Soothing and solacing himself said it’s a confirmation from Judiciary that there were fraud & forgeries in the election on the part of ECP who should have been careful but could not ensure a free, fair and transparent election where Returning officer and Presiding officer had been given a free hand who destroyed and ruined the sanctity of the electoral process particularly in Punjab.

NA 125 - Election tribunal verdict for Khawaj Saad Rafique Minister for Railway
Now if we examine the verdict of Election tribunal related to Khawaja Saad Rafique disqualification in NA 125 constituency after irregularities confirmed in general election 2013.

The Tribunal in its verdict has declared NA-125 results null and void and ordered ECP to conduct re-poll in the constituency within next sixty days

Here, PTI candidate Hamid Khan had challenged the victory of PML-N’s Saad Rafiq alleging that he rigged NA-125 polls. 

Saad Rafique however approached to Supreme Court of Pakistan and acquired ‘’stay order’’ a curse - sitting in the assembly – still associated with his ministerial business. Whereas legally he should have been de seated and detached with his portfolio.

ECP has stated that schedule of by-election on the seat will be announced.

NA 122 Election tribunal verdict for Ayaz Sadiq Speaker National Assembly
Election tribunal verdict’s related to Ayaz Sadiq Speaker National assembly NA 122 has been declared null and void due to rigging confirmed in the constituency.

The Tribunal has asked ECP to held re polling in NA 122 & PP147 confirming the PTI claims that systematic rigging had taken place in the NA-122 and PP-147 constituencies

But Ayaz Sadiq (as usual like his colleague Khawaja Saad Rafiq) said that he will go Supreme Court for the reservation he had but honours the judgement of Election tribunal and added further that tribunal did not confirmed about rigging but blamed on election machinery.

A bizarre & unending episode – according to IK there are two more constituencies which he requested earlier.

Looking forward to hear from Election tribunal to get the results of two more constituencies in addition to NA 122 & NA 125 that’s he has been asking since then.

Regarding NA 122 status of Ayaz Sadiq in national assembly is no more worthy - he has lost his seat – is no more speaker of national assembly - however the actions and decisions he took during 2-1/2 - sticking to this positon though illegally considering his recent disqualification but not invalid as the Election tribunal confirms his disqualification now.

The people of Pakistan needs ‘’neat and clean election’’ so that a real democracy in the country may establish – we are a developing country we cannot afford such deliberate error that’s make the election illegal after 2-1/2 years.

For God sake don’t spoil the election – don’t do rigging – work in your area - attend people problem - work for them - serve them - win their heart by redressing their need - and get the result from your voters instead to pressurize them or rig the election by casting bogus votes to fill the stomach of ballot boxes.

14th Aug does not mean to hoist national flag to celebrate ‘’Pakistan Independence Day’’ but the day also reminds to recommit & reaffirm with the country, stranger said

14th Aug reminds & binds us intellectually & emotionally to do solemn affirmation & a confirmation discharging onerous responsibility with commitment, loyalty & dedication whether we are a common man or ruling the country, the day asks.

A stranger among audience called some youths - Hay! What are you doing?

Is 14th Aug just a whistle of a pipe-piper where everyone comes out of his/ her comforts and start dancing jubilantly?

Number of youths & elders uttered to the stranger - we are celebrating ‘’Pakistan Independence Day’’ with unusual zeal & national spirit, fervid & excitation.

But it’s neither a whistle of a Pipe-piper, trumpeter nor drum beater but a herald & harbinger where every Pakistani filled with joyousness, happiness & obsessed with national patriotism celebrates Independence Day with ardor & fervor.

The audience chanted - we reactivate & recharge ourselves - reviving & revitalizing the engraved slogan UNITY-FAITH 8 DISCIPLINE of founder of Pakistan Quaid-e-Azam Mohamad Ali Jinnah who along with his team i.e. freedom fighters worked day and night & kept the freedom movement continued till achieving Islamic Republic of Pakistan.

The immigrant certainly paid the price for this freedom - lost millions of human lives martyred in attainment of a separate homeland - they left everything in India just for the sake of an independent state where we are living – our country Pakistan – we love it, said the group of youths radiantly.

Enabling us to live with dignity & prestige, harmony and tranquility - without depravity & subjugation - unobstructed freedom & wisdom - self-recognition & due respect.

A welfare state where every immigrant may live without barrier and impediment - a vision that we had seen – our forefather had seen, Youths said with conviction.

A legitimate constitutionally elected govt. where rule of law may maintain its supremacy and the ruler proving themselves a servant of people to provide masses ROTI - KAPRA - MAKAN easy & hassle free justice, they added .

Remembering the unparalleled sacrifices - we salute ‘’Freedom Fighters’’ who got us Pakistan – their untiring and relentless efforts cannot be overlooked - kept the freedom movement continued till getting the dream a ‘’reality’’ the Pakistan came into being on 14th Aug 1947.
A land of pure where we purify our soul on 14th Aug renewing our commitment to be loyal & patriotic always, said number of Youths with strong belief.- We are the soldiers of the country to protect every single inch of the land and will crush and kill all evil segments whoever casts a nasty look on us – it’s our country and we are the ambassador, majority of audience applauded.
The Stranger was enjoying with the vigorous & pleasant conversation - He put 2nd question. Hay! Do you do it on every 14th Aug but what were the reason you demanded a separate homeland while staying with Hindu hundreds of years?

One of the youth (among hundred jubilant bikers and cars) wrapping himself in national flag dancing on the road, replied.

Dividing Indian sub-continent was the only resolve - a resolute & unshakable faith where freedom & wisdom of Muslims were rebuffing & repelling by Hindu.

Muslims were subjecting to suppression, oppression & repression – ignoring and pushing back the legitimate rights because of Hindu dominance.
Muslims influenced with different instinct having their own culture, civilization, custom, literature, history, practices and values, religion & social life. It was quite unrealistic & impractical to merge with any other nation because the philosophy of Muslims were not adjustable & uncompromisable based on principal of Islam.
Such impression & belief became the core issue for the demand of a separate home land to safeguard Muslims and their religious identity.

We therefore celebrate the day with overwhelming emotion, ecstasies with roaring & thunder and then close the day – this is what the 14th Aug asks us to do, Youths enunciated – Stranger smiled looking the spontaneity of youths.

The stranger raised multiple questions simultaneously - Just ecstasies or does this perceptive need something else?

Does 14th Aug not need us to understand its momentum and inculcate in our soul. The real love with the country that may not eclipse & diminish its stem i.e. what we talk & what we do? No Hypocrisy?

Does 14th Aug ask us to hoist the national flag – take guards of honor – lay floral wreath in the mausoleum of Quaid-e-Mohammad Ali Jinnah & Dr. Allama Iqbal - sing national anthem. 

Decorate the govt. offices – Parliament – Governor & Chief ministers houses – Prime minster & President house s – adoring and illuminating the entire city - celebrating the day with most fervor & national enthusiasm as you said the Stranger repeated.

Further, telecasting & broadcasting special segments highlighting the day & its relevance. Issuing special edition in print media – TV Talk shows & debate narrating the importance of the day.
And after that the show goes over – you go back your home & I go back my home and wait for next 14th Aug asked the Stranger? Or 
Does 14th Aug not ask us to open our eyes to judge what we did with this country?
Did we contribute our share or just criticized & not let others to do work – kept the nation busy in economic race - increasing the prices of livelihood – keeping masses busy since dawn to dusk in search of bread & butter.

And Govt. machineries getting busy to undermine the state & its discipline involving in economic, legal & social corruption - not caring the woeful plight of common man?, the Stranger said with groan.

Making the life miserable for a common man - getting 2-3 dollars a day - resulting mothers are throwing their babies in the canal – fathers are slaughtering their children & unemployed husband pestering their wife to sell her chastity?

Why the street crimes are increasing by every passing day - the reason behind this obscene, pessimistic & frustrated attitude is the unemployment, costly living & un affordable livelihoods, Stranger asserted.
And the politicians the claimant of democracy - keeping busy in mechanism one after another that how to loot the country – Are they really patriotic? Stranger asked?
How to plunder national wealth – how to do money laundering - how to transfer money from Pakistan to overseas personal account – how to care for commission and kickbacks raising the cost of project for satiating themselves.
How to grow the business & physical assets in Middle east and Africa – In UK & Europe & how to sell out the national assets at peanut price (on false tendering documents) in the name of privatization?
Have these not been the characteristic of your Ruling elites? Do they deserve to celebrate 14th Aug infested with suspicion over their integrity, fidelity? Stranger asked with audience?

How to whiten the black money – how to develop personal business with India & Saudi Arabia to keep the Master happy & how to keep Modi Sarkar (Indian Prime minster) in favor of our premier - sending him Mango crates & Saris for his mother? Or

Is 14th Aug not a flip-flap to wake up from slumber – to appraise, assess, weigh & evaluate ourselves that what we have done with our homeland Pakistan?

Did we perform our duties honestly – Did we not cheat & damage the offices discipline, skipped the standing instructions & embezzled the money matter?

Is it not a crime that we are not performing our duties in educational institution in interior Sind & Karachi Municipality - Karachi development authority & govt. hospitals but withdrawing monthly salaries without attending the office and getting our identity as a Ghost employees? 

Do we deserve to call Pakistani? Are these our traits?
Are we not accountable before our ‘’Conscience & Al Mighty Allah’’ that what we did - what we have done & what we are doing?
We will have to check ourselves first keeping in mind that 14th Aug is the day of judgment to reconcile ourselves whether we are a normal person or we are legislators.
Why we are so prone to go short-cut, skipping the predetermined criteria to work in any employment or in business even– losing our life & pushing the family to persecute the miseries, the Stranger maintained.
This the time to go back (the past) & check in a sane and lucid manner that how truly we remained patriotic & performed our assigned task honesty, sincerity & loyalty.
Did we pay our income tax for the valuable we had with us – Did we pay govt. levies? Did we pay utility bills? Did we pay property tax – industrial tax – vehicle tax.

Did we pay off loans that we had taken from multiple commercial banks & not paid & later got the whole sum or part thereof written off on unrealistic & forged excuses?
Do we really deserve to celebrate Independence Day – or just ridiculing the day? Said the stranger angrily.
14th Aug gives us an opportunity to the people & govt. representatives (running the country) to go back to the past - correct ourselves for present - an opportunity to cleanse – purify & rectify our errors to live peacefully at a land of pure with legitimate source of income.
A time to dip not  in Ganga as Hindu do but before your conscience & Al Mighty Allah from the core of your heart to beg & implore for forgiveness & salvation with the new spirit to live in Pakistan with true patriotism not a show off, the stranger elaborated.
The stranger further emphasized that Ruling Elites sitting in the Assemblies are (unequivocally) responsible to serve the nation as they take oath before assuming offices.

According to the Constitutional Book of Pakistan they are bound to take care for ROTI – KAPRA - MAKAN – the basic amenities of life as prescribed in Article # 37 & 38 respectively.

Following excerpts however have been taken from ‘constitutional book’ enabling the reader to judge whether our govt. seriously providing the services laid down in the constitution or just a lip-service & astronomical promises as they deliver on the eve of 14th Aug. a boasting an illusion.

If govt. had been sincere & honest to at least they could introduce & implement the only two clauses (article 37 & 38) of constitutional book we would not have such heightening poverties where 110 million people are living below poverty line in Pakistan – Are these not visible to the ruler? The Stranger asked.
Constitutional preamble says; wherein the principles of democracy, freedom, equality, tolerance and social justice, as enunciated by Islam, shall be fully observed;

Wherein the Muslims shall be enabled to order their lives in the individual and collective spheres in accordance with the teachings & requirements of Islam as set out in the Holy Quran & Sunnah;

Therein shall be guaranteed fundamental rights, including equality of status, of opportunity & before law, social, economic & political justice & freedom of thought, expression, belief, faith, worship & association, subject to law and public morality;

Wherein adequate provision shall be made to safeguard the legitimate interests of minorities and backward and depressed classes

So that people of Pakistan may prosper and attain their rightful & honored place amongst the nations of the World & make their full contribution towards international peace & progress & happiness of humanity:

Now, therefore, we, the people of Pakistan,

Cognizant of our responsibility before Almighty Allah and men;

Cognizant of the sacrifices made by the people in the cause of Pakistan;

Faithful to the declaration made by the Founder of Pakistan, Quaid-i-Azam Mohammad Ali Jinnah, that Pakistan would be a democratic State based on Islamic principles of social justice;

Dedicated to the preservation of democracy achieved by the unremitting struggle of the people against oppression and tyranny;

Inspired by the resolve to protect our national and political unity and solidarity by creating an egalitarian society through a new order;

Do hereby, through our representatives in the National Assembly, adopt, enact and give to ourselves, this Constitution

Promotion of social justice and eradication of social evils.
The State shall:

promote, with special care, the educational and economic interests of backward classes or areas;

remove illiteracy and provide free and compulsory secondary education within minimum possible period;

make technical and professional education generally available and higher education equally accessible to all on the basis of merit;

ensure inexpensive and expeditious justice;

make provision for securing just and humane conditions of work, ensuring that children and women are not employed in vocations unsuited to their age or sex, and for maternity benefits for women in employment;

enable the people of different areas, through education, training, agricultural and industrial development and other methods, to participate fully in all forms of national activities, including employment in the service of Pakistan;

prevent prostitution, gambling and taking of injurious drugs, printing, publication, circulation and display of obscene literature and advertisements;

prevent the consumption of alcoholic liquor otherwise than for medicinal and, in the case of non-Muslims, religious purposes; and

decentralize the Government administration so as to facilitate expeditious disposal of its business to meet the convenience and requirements of the public.

Promotion of social and economic well-being of the people.
The State shall:
Secure the well-being of the people, irrespective of sex, caste, creed or race, by raising their standard of living, by preventing the concentration of wealth and means of production and distribution in the hands of a few to the detriment of general interest and by ensuring equitable adjustment of rights between employers and employees, and landlords and tenants;
provide for all citizens, within the available resources of the country, facilities for work and adequate livelihood with reasonable rest and leisure;

provide for all persons employed in the service of Pakistan or otherwise, social security by compulsory social insurance or other means;
Provide basic necessities of life, such as food, clothing. housing, education and medical relief, for all such citizens, irrespective of sex, caste, creed or race, as are permanently or temporarily unable to earn their livelihood on account of infirmity, sickness or unemployment;
Reduce disparity in the income and earnings of individuals, including persons in the various classes of the service of Pakistan

If the govt. had ensured and implemented at least these two Article 37 & 38 in its real term and spirit – the country would not have confronted with such crisis where we have a big jaw of frustration between rich and poor..

After a while when youth wanted to see him again they could not find - looked around but could not trace.
An elderly man in his 70s, who was watching the question-answer session between audience and the Stranger asked - Do you know who was he?

He was your ‘’conscience’’ just came to remind us the importance of 14th Aug & signifying your responsibility asking Govt. of Pakistan the ruler to give its people a welfare state enabling everyone to live with harmony in this homeland.
